President Returns Constitutional Council Ordinance for Reconsideration
President Ram Chandra Paudel has returned the “Constitutional Council (Functions, Duties, Powers and Procedures) (First Amendment) Ordinance, 2083” to the Council of Ministers for reconsideration.
According to the Office of the President, the ordinance, recommended by the Cabinet on 27 April 2026, has been sent back with observations for further review.
The President’s Office recalled that a previous version of the amendment bill related to the Constitutional Council Act, 2066, had been submitted for authentication on 9 July 2025, but was returned to the Cabinet with a message, and the ordinance proposed on 18 November 2025 was not issued.
The statement further notes that the latest ordinance has again been returned for reconsideration based on its content and legal provisions.
The Constitutional Council consists of six members, including the Prime Minister. Reports suggest the proposed amendment sought to allow decisions to be finalized by the Prime Minister and three members, a provision earlier flagged as inconsistent with the Constitution and the governing law of the Council.
The President had previously returned a similar proposal citing constitutional concerns.
Meanwhile, President Paudel has issued the “Some Nepal Acts Amendment Ordinance, 2083.” With this, out of eight ordinances presented at the President’s Office, seven have been authenticated while one has been returned.
